NOTICE

The Association of Finance Companies Malaysia (AFCM) and the Association of Hire Purchase Companies of Malaysia (AHPCM) formed Financial Information Sdn Bhd in 1986.


Introduction

FIS Data Reference Sdn Bhd ("FDR") is a credit reporting agencies regulated under the Credit Reporting Agencies Act 2010.

Confidentiality Of Information

As per the Subscriber Agreement, the supply of information by FDR to Subscribers is strictly on a confidential basis. According to the Credit Reporting Agencies Act (2010), the information is supplied to Subscribers by FDR after the subject's written consent has already been obtained by the Subscribers, and such information is meant solely for the Subscribers own discretionary use.

FDR takes a grave view of the unauthorised disclosures to third parties, and will strictly enforce the provisions of the Subscriber Agreement in the event of such practices. Subscribers should ensure that their officers or employees adhere to the Subscriber Agreement.

Reports from FDR are strictly Private & Confidential - For internal use only. No person or entity, except the subject concern, shall be entitled to obtain, view or use the report without written consent from FDR.

It is to be noted that FDR is not a party to any credit decision made or to be made by the Subscribers.

To ensure that such applications remain confidential and secure, FDR uses 256-bit SSL encryption technology to protect the data being transmitted between the Web browser and our systems. For added security, Subscriber's online session will be timed out after a specific period of inactivity and only authorised personnel from FDR are permitted to access the information.

The Purpose of Collecting Credit Information

FDR collects credit information, which is then processed, maintained and stored in a data-base ("Data-base"). Upon enquiry by its subscribing users ("Subscribers"), FDR provides Subscribers with commercial, credit, financial and other relevant public record information pertaining to the businesses carried on by the Subscribers.
Subscribers may access the credit information of a subject ("Customer") by keying in the Customer's identification number or business registration number.

Source of Credit Information

    The credit information contained within FDR's Data-base is collected from the following sources:
    • information provided by Subscribers; and
    • information provided directly from you (all information provided by you shall be on a voluntary basis, and you have the option of not disclosing credit information relating to other persons who can be identified from that credit information).

Description of Credit Information

    FDR collects and maintains in its Data-base is collected from the following sources:
    • identification particulars of motor vehicles, goods, equipment and other loan facilities which may have been granted by Subscribers;
    • identification particulars of hirers, lessees, borrowers and guarantors;
    • a list of subscribers who/which have requested a copy of a Customer's credit report.

Customer's Consent

FDR may obtain your consent to disclose your information directly from you, or indirectly from you through one of our Subscribers.
Depending on the circumstances, you may give your consent either in writing or electronically.
When Subscribers request for a credit report regarding a Customer, they must have the Customer's consent to do so. This consent allows Subscribers to disclose information to FDR, and allows FDR to collect, use and disclose such information in a future credit report in accordance to the Credit Reporting Agencies Act 2010.

Queries / Request for Correction of Credit Information

If you received your Credit Report by email and you believe that any item in your Credit Report is not accurately reported ("Disputed Item"), please tick in the "Request Verification" box besides the record which you wanted us to verify and key in your comments and requests. All verification requests must be attached with supporting documents for verification by sending an email to dispute@fis.com.my. When completed reviewing all your records, click "Submit" button to submit the records to FDR.

If you received your Credit Report by post and you believe that any item in your Credit Report is not accurately reported ("Disputed Item"), please fill up the Request for Data Verification Form which attached together with your Credit Report. All verification requests must be attached with supporting documents for verification. Return the Request for Data Verification Form, your Credit Report highlighted with the Disputed Item and supporting document to FDR by post.

Upon receipt of your verification request we will contact the source of the information reported in your Credit Report to verify the Disputed Item.

If we are unable to confirm the Disputed Item, we will remove the Disputed Item from your Credit Report. If we receive updated information from the person or company that provided it, we will adjust the information accordingly.

If we make any changes to your Credit Report, we will notify you through email or phone on such changes and you will have to retrieve your Credit Report showing the changes which were made as a result of the dispute resolution process. We will also send your revised Credit Report to any Subscriber who may have recently received your Credit Report.

In the event that the Disputed Item is confirmed accurate, you are advised to refer the matter to the respective credit grantor or source.

Summary of Rights

  1. You must be informed by the credit reporting agency by way of a written notice which states:
    1. That credit information is being processed by or on behalf of the credit reporting agency together with its description;
    2. the purpose for which the information is being processed;
    3. the source of such credit information;
    4. of how you can contact the credit reporting agency in case you have any inquiries or complaints;
    5. you have the right to access to such information and also have the right to request the credit reporting agency to correct your credit information;
    6. to whom the credit reporting agency discloses or may disclose the credit information;
    7. of the choices and means the credit reporting agency offers you for limiting the processing of credit information, including credit information relating to other persons who can be identified from that credit information;
    8. whether it is obligatory or voluntary for you to supply the credit information;
    9. whether it is obligatory for you to supply the credit information, the consequences for you if you fail to supply the credit information; and
    10. of a summary of yours rights as contained in the Summary of Rights.
  1. Your credit information cannot be collected and used for any purpose other than what is provided under the Credit Reporting Agencies Act 2010.

This means that a credit reporting agency, may only collect and use your credit information to prepare a credit report to assess your credit worthiness, which includes but is not limited, to any history of failure or diligence regarding payment of your bills (reputational collateral). Your credit information cannot be used or disclosed by any credit reporting agency for purposes other than what is permitted under the Credit Reporting Agencies Act 2010. An example of such activity includes but is not limited to, disclosing your credit information for direct marketing purposes. In the event that you have information regarding the occurrence of such practice, then a complaint may be forwarded to the Registrar.

  1. Your consent must be obtained before a credit reporting agency can disclose/reveal your credit information

This means that a credit reporting agency must get your consent before they can submit your credit report to their subscribers

  1. Your credit report can only contain information according to the Act

This means that a credit reporting agency shall not include any of the following credit information in a credit report regardless whether you have given consent or not:

    1. any information unless such information includes the name and address of the source of the credit information;
    2. any information unless the identity of the customer can be identified;
    3. any information in relation to a person's bankruptcy two (2) years after the date of his discharge from the bankruptcy;
    4. any information in relation a pecuniary action in court against a person more than two (2) years after the date of commencement of the proceedings, unless the current status of the court action has been ascertained and is included in the credit report; and
    5. any information in relation to any default in repayment of credit two (2) yeas after the date of final settlement of the amount in default, including settlement of the amounts payable pursuant to a scheme of arrangement with the credit provider.
  1. Your right to request from a credit provider information regarding reasons of unfavourable credit action

Where a credit provider has taken an unfavourable credit action against you based on a credit report, the credit provider shall, upon your request, disclose to you:

    1. that the unfavourable credit action was on the basis of the credit report provided by a credit reporting agency; and
    2. the identity of the credit reporting agency from which the credit report was obtained that resulted in such unfavourable credit action.
  1. Your right to access credit information or credit report 

A credit reporting agency shall not later than twenty one (21) days from the date of receipt of your access request provide you with a confirmation of whether or not the credit reporting agency has processed your credit information and where the credit reporting agency has processed your credit information, it shall allow you to access to the credit information held or allow you to have access to the credit information held and any credit report furnished by the credit reporting agency to any subscriber or other person. This means that you have the rights to have access to your credit information or credit report from a credit reporting agency which holds or have processed your credit report. However the credit reporting agency must verify your identity and confirm that such information is indeed in their database before complying. Upon your request and upon payment of any fee which may be prescribed by the agency in custody of your credit information.

  1. Your right to dispute incorrect credit information

This means that if your credit report which was disclosed to the credit provider in response to the application for credit made by you, and such credit report contain inaccurate, not up-to-date, incomplete, irrelevant or misleading information, you then have the right to correct such credit report according to the procedures provided under the Credit Reporting Agencies Act 2010.

Mukadimah

FIS Data Reference Sdn Bhd ("FDR") adalah sebuah agensi pelaporan kredit yang dikawal selia di bawah Akta Agensi Pelaporan Kredit 2010.

Tujuan Mengumpul Maklumat Kredit

FDR mengumpul maklumat kredit, yang kemudiannya diproses, disenggarakan dan disimpan dalam pangkalan data ("Pengkalan Data").
Atas permintaan oleh orang yang melanggan perkhidmatan FDR ("Pelanggan"), FDR akan membekalkan maklumat kredit perdagangan, kewangan dan maklumat awam yang berkaitan dengan perniagaan yang dijalankan oleh Pelanggan. Pelanggan boleh mengakses maklumat kredit subjek dengan memasukkan nombor kad pengenalan atau nombor pendaftaran perniagaan subjek tersebut.

Sumber Maklumat Kredit

    Maklumat kredit yang terkandung dalam Pengkalan Data FDR adalah dikumpul daripada sumber-sumber berikut:
    • Maklumat yang diberikan oleh Pelanggan; dan
    • Maklumat yang diberikan secara langsung oleh anda. (Kesemua maklumat yang diberi oleh anda adalah secara sukarela, dan anda mempunyai pilihan untuk tidak menzahirkan maklumat tersebut jika identiti orang lain boleh dikenalpasti daripada maklumat kredit tersebut).

Perihalan Maklumat Kredit

    FDR mengumpul dan menyenggarakan maklumat-maklumat berikut dalan Pangkalan Data:
    • Butir-butir kenderaan bermotor, barang-barang, peralatan dan kemudahan pinjaman lain yang mungkin telah diberikan oleh Pelanggan;
    • Butir-butir penyewa, penerima pajakan, peminjam dan penjamin;
    • Senarai Pelanggan-Pelanggan yang telah meminta salinan laporan kredit anda.

Persetujuan Anda

FDR boleh mendapatkan persetujuan anda untuk menzahirkan maklumat anda secara langsung daripada anda, atau secara tidak langsung daripada anda melalui salah satu Pelanggan kami.
Bergantung pada keadaan, and boleh menberikan persetujuan anda sama ada secara bertulis atau elektronik.
Apabila Pelanggan kami meminta laporan kredit mengenai anda, mereka mesti mempunyai persetujuan anda untuk berbuat demikian. Persetujuan ini membolehkan Pelanggan untuk menzahirkan maklumat kepada FDR, dan membolehkan FDR untuk mengumpul, menggunakan dan menzahirkan apa-apa maklumat dalam laporan kredit pada masa depan mengikut Akta Pelaporan Kredit 2010.

Pertanyaan / Permohonan Pembetulan Maklumat Kredit

Jika anda menerima Laporan Kredit anda melalui emel dan anda percaya bahawa mana-mana rekod dalam Laporan Kredit anda dilaporkan secara tidak tepat ("Rekod yang Dipertikaikan"), sila tanda di dalam kotak "Request Verification" (Permintaan Pengesahan) di sebelah Rekod yang Dipertikaikan dan masukkan komen (Remark) and permintaan anda. Untuk setiap pemintaan pengesahan, mesti disertakan dengan dokumen sokongan untuk pengesahan dengan menghantar email ke dispute@fis.com.my. Setelah siap semak kesemua rekod, klik butang "Submit" untuk menghantar rekod ke FDR

Jika anda menerima Laporan Kredit anda melalui pos dan anda percaya bahawa mana-mana rekod dalam Laporan Kredit anda dilaporkan secara tidak tepat ("Rekod yang Dipertikaikan"), sila isi Borang Permohonan Semakan Data yang dilampirkan bersama Laporan Kredit anda. Setiap pemintaan pengesahan, mesti disertakan dengan dokumen sokongan untuk pengesahan. Kembalikan Borang Permohonan Semakan Data, Laporan Kredit ditandakan dengan Rekod yang Dipertikaikan disertakan dengan dokumen sokongan melalui pos ke FDR.

Apabila kami menerima pemintaan pengesahan anda, FDR akan menghubungi sumber maklumat seperti yang dilaporkan di dalam Laporan Kredit anda untuk membuat pengesahan ke atas Rekod yang Dipertikaikan.

Jika kami tidak dapat membuat pengesahan terhadap Rekod yang Dipertikaikan, kami akan mengeluarkan Rekod yang Dipertikaikan daripada Laporan Kredit anda. Jika kami menerima maklumat yang dikemaskini dari sumber yang membekalkan maklumat tersebut, kami akan mengemaskinikan maklumat dengan sewajarnya.

Jika kami membuat sebarang perubahan kepada Laporan Kredit anda, anda akan dimaklumkan melalui emel atau panggilan talipon mengenai perubahan tersebut. Anda akan mendapat Laporan Kredit anda yang kemaskini setelah perubahan dibuat hasil daripada proses penyelesaian pertikaian. Kami juga akan menghantar Laporan Kredit anda yang kemaskini kepada mana-mana Pelanggan FDR yang mungkin telah menerima Laporan Kredit anda.

Sekiranya Rekod yang Dipertikaikan disahkan tepat, anda dinasihatkan untuk merujuk perkara itu kepada pemberi kredit atau sumber maklumat tersebut.

RINGKASAN HAK

  1. Anda mesti dimaklumkan oleh agensi pelaporan kredit melalui suatu notis yang menyatakan bahawa:
    1. maklumat kredit sedang diproses oleh atau bagi pihak agensi pelaporan kredit bersama-sama dengan penjelasan;
    2. tujuan yang mana maklumat yang sedang dan akan diproses;
    3. sumber maklumat itu;
    4. bagaimana anda boleh menghubungi agensi pelaporan kredit jika anda mempunyai sebarang pertanyaan atau aduan;
    5. anda mempunyai hak untuk akses kepada maklumat itu dan juga mempunyai hak untuk meminta agensi pelaporan kredit untuk membetulkan maklumat kredit anda;
    6. kepadanya maklumat kredit akan dizahirkan;
    7. pilihan yang ditawarkan oleh agensi pelaporan kredit kepada anda untuk menghadkan pemprosesan maklumat kredit, termasuk maklumat kerdit yang berhubungan dengan orang lain yang boleh dikenal pasti daripada maklumat kredit;
    8. samada wajib atau sukarela bagi anda untuk memberikan maklumat kredit itu;
    9. samada wajib untuk anda memberikan maklumat kredit itu dan tindakan/kesan jikalau anda gagal memberikan maklumat kredit; dan
    10. senarai hak-hak anda seperti yang terkandung dalam Ringkasan Hak.
  1. Maklumat kredit anda tidak boleh dikumpul dan digunakan untuk apa-apa tujuan selain daripada tujuan yang disediakan dibawah Akta Agensi Pelaporan Kredit 2010.

Ini bermakna bahawa agensi pelaporan kredit hanya boleh mengumpul dan menggunakan maklumat kredit anda untuk menyediakan laporan kredit untuk menilai tahap kredit anda, yang termasuk tetapi tidak terhad kepada mana-mana sejarah kegagalan atau usaha anda dalam pembayaran bil-bil anda (cagaran reputasi). Maklumat kredit anda tidak boleh digunakan atau dizahirkan oleh mana-mana agensi pelaporan kredit bagi tujuan selain daripada apa yang dibenarkan dibawah Akta Agensi Pelaporan Kredit2010. Salah satu contoh aktiviti itu termasuk tetapi tidak terhad kepada menzahirkan maklumat kredit anda untuk tujuan pemasaran langsung. Sekiranya anda mempunyai maklumat mengenai amalan itu, maka aduan boleh dikemukakan kepada Pendaftar.

  1. Persetujuan anda mesti diperolehi sebelum agensi pelaporan kredit boleh mengemukakan/menzahirkan maklumat kredit anda

Ini bermakna bahawa agensi pelaporan kredit perlu mendapatkan persetujuan anda sebelum mereka boleh mengemukakan laporan kredit anda kepada Pelanggan mereka.

  1. Laporan kredit anda hanya boleh mengandungi maklumat mengikut Akta

Ini bermakna tidak kira sama ada anda telah memberikan persetujuan atau tidak, agensi pelaporan kredit tidak boleh memasuki maklumat kredit berikut di dalam laporan kredit mereka:

    1. jika nama dan alamat sumber maklumat kredit itu tidak termasuk dalam laporan;
    2. jika identiti subjek tidak boleh dikenal pasti;
    3. jika maklumat kebankrapan seseorang dimana tarikh perlepasan kebankrapan adalah lebih daripada dua tahun;
    4. jika maklumat kredit itu adalan berkenaan dengan prosiding mahkamah yang belum selesai dan yang lebih daripada dua tahun selepas prosiding bermula;
    5. (v) jika maklumat kredit itu adalah mengenai keingkaran dalam pembayaran kredit di mana tarikh penyelesaian muktamadnya adalah lebih daripada dua tahun.
  1. Hak anda untuk meminta daripada pemberi kredit mengenai sebab-sebab tindakan kredit tidak memihak kepada anda

Ini bermakna bahawa jika pemberi kredit telah mengambil suatu tindakan kredit tidak memihak terhadap anda, sebagai contoh, menolak permohonan anda untuk pinjaman,dan penolakan tersebut adalah berdasarkan laporan kredit yang disediakan oleh agensi pelaporan kredit, maka anda mempunyai hak untuk dimaklumkan identiti agensi pelaporran kredit tersebut. Anda mempunyai hak untuk mengakses laporan kredit tersebut.

  1. Hak anda untuk akses maklumat kredit atau laporan kredit 

Ini bermakna bahawa anda mempunyai hak untuk mengakses kepada maklumat kredit atau laporan kredit anda daripada agensi pelaporan kredit yang memegang atau telah memproses laporan kredit anda. Walau bagaimanapun, agensi pelaporan kredit perlu membuat pengesahan identiti anda dan mengesahkan bahawa maklumat itu memang dalam pangkalan data mereka sebelum mematuhi. Atas permintaan anda dan setelah bayaran apa-apa fi yang ditetapkan oleh agensi yang mana maklumat kredit anda berada dalam jagaan mereka.

  1. Hak anda untuk mempertikaikan maklumat kredit yang tidak betul

Ini bermakna bahawa jika laporan kredit anda yang telah dizahirkan kepada pemberi kredit atas permohonan anda untuk mendapatkan kemudahan kredit, dan laporan kredit itu mengandungi maklumat yang tidak tepat, maka anda mempunyai hak untuk mempertikaikan laporan kredit itu mengikut prosedur yang diperuntukkan di bawah Akta Agensi Pelaporan Kredit 2010.
